2025 Proposed Rules to Revise Endangered Species Act Regulations

The U.S. Fish and Wildlife Service and NOAA Fisheries (the Services) jointly proposed revisions to regulations that implement portions of the Endangered Species Act (ESA).

One proposed rule would revise regulations governing listing, delisting, and critical habitat determinations made pursuant to section 4 of the ESA. The other proposed rule would revise regulations governing procedures and standards for consultations between other federal agencies and the Services pursuant to section 7 of the ESA.

We are currently soliciting public comments on these proposals; the public comment periods will be open through December 22, 2025.
