Summary

Description

A dealer permit is required for the first purchaser of catch from a Federally permitted fishing vessel. It allows a company to buy catch that are regulated by a Fishery Management Plan. The permit identifies the Fishery Management Plan (FMP) that regulates the catch that may be purchased and, sometimes, a category, which indicates what the dealer intends to do with the catch, e.g., process it. Multiple species may be listed on a single dealer permit.

A dealer needs only one permit, irrespective of the number of locations where it actually purchases the catch. The only exception to this rule is that every dealer vessel requires its own permit; thus, if a dealer owns multiple vessels, it needs multiple permits.

In order to obtain a permit, the dealer must fill out and submit an application form. Permits must be renewed every year, by submitting a renewal application. Requests for renewal will be denied if the dealer is not in compliance with the applicable electronic reporting requirements.

Purpose:

The Dealer Permit System manages the Dealer permitting process; To document the data sets used to issue dealer permits.

Notes:

The Dealer Permit System consists of a Oracle forms application, two Oracle reports that provide application forms and permits, and a set of oracle tables to store the Dealer data.

Data Access Procedure:

Access to data is governed by 50CFR600 - Confidentiality of Information. Access by state fishery management agency staff and Fisheries Management Council staff may be allowed through Memorandum of Understanding that are signed by the Greater Atlantic Regional Administrator and Directors of the State Agency or Councils that describe the need and uses of the data and list the individuals who will have access to the data. Contractors may be granted access provided they are working under contract to NOAA or a cooperating partner (state, Council, Commission) on a specific project under the oversight of a partner.

Data Access Constraints:

Access is restricted to personnel authorized in accordance with NOAA Administrative Order 216-100. A signed non-disclosure agreement must be on file for all authorized personnel. The IRM help desk or APSD Data Request staff are the POC for non-disclosure forms.
