IB 99-48: NMFS Implements a Final Rule Amending Regulations for Vessels Harvesting Halibut CDQ

The National Marine Fisheries Service (NMFS) implemented a final rule to amend regulations for vessels harvesting halibut Community Development Quota (CDQ), according to Steven Pennoyer, Administrator, Alaska Region. The final rule was published in the Federal Register on April 26, 1999 (64 FR 20210) and is effective on May 26, 1999.

This final rule permanently extends the requirement that the catch of halibut CDQ be managed under the Individual Fishing Quota Program regulations. In addition, the final rule implements requirements for accounting for groundfish catch while halibut CDQ fishing that differ depending on the length overall (LOA) of the harvesting vessel. Groundfish caught on vessels less than 60 ft LOA while halibut CDQ fishing do not accrue against the CDQ group's allocations and a CDQ observer is not required to monitor deliveries at the shoreside processor from these vessels. However, this final rule extends CDQ catch accounting and observer coverage requirements to vessels equal to or greater than 60 ft length overall while halibut CDQ fishing and to shoreside processors taking deliveries from these vessels. The final rule also authorizes the catch of CDQ and IFQ species in the same set by catcher/processors.
