Biological Opinion on Reissuance of the Construction General Permit by the Environmental Protection Agency

This document represents NOAA Fisheries' opinion on the EPA's reissue of its Construction General Permit and the possible effects on threatened and endangered species and designated critical habit.
On June 20, 2003, NOAA Fisheries' Office of Protected Resources issued a concurrence on EPA’s 2003 Clean Water Act Construction General Permit but did not complete consultation on the 2008 CGP or the 2012 CGP that followed. The EPA issued its current CGP on February 16, 2012. That permit expires February 16, 2017.
