Summary: NOAA Fisheries has received a request from Park City Wind, LLC for Incidental Take Regulations and an associated Letter of Authorization. The requested regulations would govern the authorization of take, by Level A harassment and/or Level B harassment, of small numbers of marine mammals over the course of 5 years (2025-2030) incidental to construction of the New England Wind Project. Park City Wind proposes to develop the New England Wind Project in two phases, known as Park City Wind (Phase 1) and Commonwealth Wind (Phase 2). Project activities that may result in incidental take include pile driving (impact and vibratory), drilling, unexploded ordnance or munitions and explosives of concern detonation, and vessel-based site assessment surveys using high-resolution geophysical equipment. If adopted, the proposed regulations would be effective March 27, 2025, through March 26, 2030.

Atlantic Shores South would be divided into two projects: Project 1 and Project 2 (the combined hereafter referred to as the “Project Area”) and Atlantic Shores has requested a 5-year LOA for each Project, both issued under these proposed regulations. Atlantic Shores’ activities likely to result in incidental take include impact and vibratory pile driving and site assessment surveys using high-resolution geophysical equipment within the Lease Area and Export Cable Corridor. NOAA Fisheries requests comments on its proposed rule. NOAA Fisheries will consider public comments prior to making any final decision on the promulgation of the requested ITR and issuance of the LOA; agency responses to public comments will be summarized in the final rule documenting our decision.

Summary: NOAA Fisheries has received a request from Orsted Wind Power North America, LLC, and its designees, Garden State Offshore Energy, LLC and Skipjack Offshore Energy, LLC, for the re-issuance of a previously issued incidental harassment authorization (IHA; 87 FR 30182, May 10, 2022) with the only change being effective dates. The initial IHA authorized take of 16 species of marine mammals, by Level B harassment only, incidental to marine site characterization surveys off the coast of Delaware and along potential export cable routes to landfall locations in Delaware and New Jersey. The project has been delayed and none of the work covered in the initial IHA has been conducted. The initial IHA was effective from May 10, 2022, through May 9, 2023. Orsted has requested re-issuance with new effective dates of May 10, 2023, through May 9, 2024. The scope of the activities and anticipated effects remain the same, authorized take numbers are not changed, and the required mitigation, monitoring, and reporting remains the same as included in the initial IHA. NOAA Fisheries is, therefore, issuing a second identical IHA to cover the incidental take analyzed and authorized in the initial IHA.
