Mission Bay Ferry and Water Taxi Landing Project in San Francisco Bay, California

Summary: NOAA Fisheries has received a request from the Port of San Francisco for authorization to take marine mammals incidental to the Mission Bay Ferry and Water Taxi Landing Project in San Francisco Bay, California.  Pursuant to the Marine Mammal Protection Act (MMPA), NOAA Fisheries is requesting comments on its proposal to issue an incidental harassment authorization (IHA) to incidentally take marine mammals during the specified activities.  NOAA Fisheries will consider public comments prior to making any final decision on the issuance of the requested MMPA authorization and agency responses will be summarized in the final notice of our decision.

Alaska DOT Gustavus Ferry Terminal Improvement Project, Gustavus AK

Summary: NOAA Fisheries has received a request from Alaska Department of Transportation (ADOT&PF) to issue an IHA for activities that were not conducted under an existing IHA. We previously issued an IHA to ADOT&PF to incidentally take seven species of marine mammal, by Level A and Level B harassment. The IHA, issued on April 4, 2017, is valid from December 15, 2017 through December 14, 2018. However, ADOT&PF was unable to conduct any of the work and, therefore, has requested that NOAA Fisheries re-issue the IHA with the dates changed to accommodate the analyzed work with minor modifications to the number of piles driven. The proposed IHA would authorize work for the ferry improvements project between December 15, 2018 and December 14, 2019. Pursuant to the MMPA, NOAA Fisheries is requesting comments on the proposed issuance of an IHA to incidentally take marine mammals during the specified activities. Take numbers would be the same as authorized previously, and the mitigation, monitoring, and reporting requirements would remain the same as authorized for the 2017-2018 IHA referenced above.

Port of Kalama Expansion Project, Kalama, WA (2018-2019)

Summary: NOAA Fisheries has received a request from the Port of Kalama (POK) to issue an IHA previously issued to the POK to incidentally take three species of marine mammal, by Level B harassment only, during construction activities associated with an expansion project at the Port of Kalama on the Lower Columbia River, Washington. The current IHA was issued in 2017 and is in effect until August 31, 2018 (2017-2018 IHA). However, the project has been delayed such that none of the work covered by the 2017-2018 IHA has been initiated and, therefore, the POK requested that an IHA be issued to conduct their work beginning on or about September 1, 2018 (2018-2019 IHA). NOAA Fisheries is seeking public comment on its proposal to issue the 2018-2019 IHA to cover the incidental take analyzed and authorized in the 2017-2018 IHA. Pursuant to the Marine Mammal Protection Act, NOAA Fisheries is requesting comments on its proposal to issue an IHA to POK to incidentally take, by Level B harassment, small numbers of marine mammals during the specified activities. The authorized take numbers and related analyses would be the same as for the 2017-2018 IHA, and the required mitigation, monitoring, and reporting would remain the same as authorized in the 2017-2018 IHA referenced above. NOAA Fisheries will consider public comments prior to making any final decision on the issuance of the requested MMPA authorization and agency responses will be summarized in the final notice of our decision.

Washington Department of Transportation Mukilteo Multimodal Project, Puget Sound, Washington (Season 3 2018)

SUMMARY: NOAA Fisheries has received a request from the Washington Department of Transportation (WSDOT) Ferries Division (WSF) for an incidental harassment authorization (IHA) that would cover a subset of the take authorized in an IHA previously issued to WSDOT to incidentally take marine mammals, by Level B harassment only, during construction activities associated with the Mukilteo Multimodal Project, Puget Sound, Washington. During planning of season 2 of the project (for which NOAA Fisheries issued an IHA) it was assumed that the project would be completed within the year timeframe; however, that was not accomplished. Therefore, WSDOT is requesting, and NOAA Fisheries is proposing to issue, an IHA authorizing incidental take for the remaining work which was already analyzed in an 2017 IHA issued to WSDOT on August 3, 2017.

    Transfer of Casitas Pier Fender Pile Replacement Project in Carpinteria, CA from Venoco, LLC to Chevron USA, Inc. 

    SUMMARY: NOAA Fisheries has received a request from Venoco, LLC, (Venoco) and Chevron USA, Inc., (Chevron) to transfer, from Venoco to Chevron, a Marine Mammal Protection Act (MMPA) one-year Incidental Harassment Authorization (IHA) to take marine mammals, by harassment, incidental to the Casitas Pier Fender Pile Replacement Project, following the sale of Casitas Pier to Chevron.                               Summary: On August 3, 2016, NOAA Fisheries issued an IHA to the U.S. Navy for Year 1 of the Bravo Wharf Recapitalization Project (81 FR 52637; August 9, 2016). On February 22, 2017, NOAA Fisheries published a notice of a revision of the IHA (82 FR 11344), revising the effective authorization dates from March 13, 2017, through March 12, 2018. On January 9, 2018, the Navy formally requested that NOAA Fisheries issue an IHA for one year from May 14, 2018, to May 13, 2019 in order to complete a subset of the construction activity previously covered by the 2017 IHA. In accordance with the regulations implementing the Marine Mammal Protection Act, as amended, notification is hereby given that NOAA Fisheries has issued an IHA to the U.S. Navy (Navy) for the take, by Level B harassment only, of bottlenose dolphins (Tursiops truncatus), incidental to the Bravo Wharf Recapitalization Project at Bravo Wharf, Naval Station Mayport, Florida, effective May 14, 2018, to May 13, 2019.

                              Summary: Upon application from the U.S. Navy (Navy), NOAA Fisheries is issuing regulations under the Marine Mammal Protection Act for the taking of marine mammals incidental to the pier construction activities conducted at the Naval Submarine Base New London in Groton, Connecticut, over the course of five years (2020-2025).  These regulations allow NOAA Fisheries to issue a Letter of Authorization (LOA) for the incidental take of marine mammals during the specified construction activities carried out during the rule’s period of effectiveness, set forth the permissible methods of taking, set forth other means of effecting the least practicable adverse impact on marine mammal species or stocks and their habitat, and set forth requirements pertaining to the monitoring and reporting of the incidental take.

                              NOAA Fisheries has received a request from the City of San Diego (the City) for an incidental harassment authorization (IHA) to take three species of marine mammals, by Level B harassment only, incidental to Coast Boulevard improvements in La Jolla, California. The project has been delayed, such that none of the work covered in the identical IHA issued in 2017 was initiated and, therefore, the City requested that an identical IHA be issued to cover the same work in 2018. NOAA Fisheries is, therefore, issuing a second IHA to cover the incidental take analyzed and authorized in the initial IHA. The scope of the activities and anticipated effects remain the same, authorized take numbers would not change, and the required mitigation, monitoring, and reporting would remain the same as authorized in the 2017 IHA referenced above. NOAA Fisheries is therefore notifying the public about the issuance of an IHA to the City to incidentally take marine mammals, by Level B harassment only, during the City’s Coast Boulevard improvements.

NOAA Fisheries is, therefore, issuing a second IHA to cover the incidental take analyzed and authorized in the first IHA. The authorized take numbers would be the same as authorized previously, and the required mitigation, monitoring, and reporting would remain the same as authorized for the 2018 IHA referenced above.
